FRANÇOIS' TERMS AND CONDITIONS

Please note that these are general guidelines compiled to assist clients ( referred to hereafter as “the Traveller”).  They are not exhaustive or definitive. The purchase of travel or related services from François Gauthron by the Traveller constitutes a contractual agreement and implies the Traveller’s acceptance of the Terms and Conditions listed below. Therefore, please make sure you have carefully read and understood these Terms and Conditions before making your reservation.

1. Prices

All prices are quoted in Euros (€) unless otherwise indicated. AEBT reserves the right to increase or decrease published prices without prior notice. Several factors may influence changes to prices, including, but not limited to, an increase in the cost of aviation or any other transportation fuel, hotel taxes, and  government taxes. These charges may be included in the travel service price or shown as an additional amount, depending on the destination. Price reductions are applicable to new bookings only.

2. Reservations

2a. Individual Reservations

Reservations are made in the name of the traveller. Reservations should be accompanied by a deposit or payment in full before a reservation can be confirmed. Unless otherwise indicated in these Terms and Conditions, all amounts are per person.

2b. Group Reservations

Reservations must be accompanied by a deposit or payment in full before a reservation can be confirmed. Unless otherwise indicated in these Terms and Conditions, all amounts are per group.

3. Payment and Deposit Arrangements

Payment and Deposit arrangements will be determined at the time of booking. Final payment must be received by AEBT according to the agreement between AEBT and the traveller agreed at the time of booking.. If final payment is not received in accordance with such agreement, AEBT or any  service providers represented by AEBT reserve the right to cancel any such reservations without prior notice and levy applicable cancellation fees.

4. Cancellation Insurance

Prices do not include any provision for cancellation protection. AEBT strongly recommends that all travellers purchase cancellation protection at the time of booking.

5. Payment by Credit Card

Verbal or electronic authorisation given by travellers to AEBT for the use of a Credit Card confirms the reservation, whether a paper document is signed or not. However, upon request by AEBT, travellers must confirm in writing, and send by fax, authorisation that the Credit Card may be used without their signature.

6. Transfer of Entitlements

Reservations are made in the name of the traveller who confirms the original booking. Such reservations cannot be transferred directly to another traveller. For legal reasons it is necessary for AEBT  to cancel the original reservation and open a new account in the name of the traveller to whom the reservation is to be transferred. Appropriate cancellation charges will apply.

7. Cancellation Charges

Unless otherwise provided in these Terms and Conditions, the following charges will apply in the event of any cancellation:

In case the ship cancels the call due to weather conditions or any other circumstance:

8. Cancellation Protection

For added security and peace of mind Travellers should consider Cancellation Protection Insurance. For information and details about the cancellation protection and other insurances contact Gold Star Travel 305 792 0400. Travel insurance must be purchased no later than payment date for tours offered by AEBT

9. Travel Documents

It is the responsibility of travellers to obtain at their own expense all documents required by all relevant government authorities. American citizens must show a valid passport when travelling outside the United States. One (1) parent travelling with a child may have to produce an affidavit signed by the other parent authorising the child to travel. At the time of booking, travellers must check with AEBT to find out which documents are required, and have the documents to hand prior to departure. The carrier or relevant authorities, without further recourse or the possibility of a refund, may deny travellers access or privileges if they fail to provide the required documents. No refund or replacement will be given for lost or stolen travel documents.

10. Limitation of Liability

The traveller accepts that unforeseeable events may occur when travelling abroad, and  agrees that AEBT or any tour operator, product or service providers represented by AEBT cannot be held responsible for the consequences. These events include but are not limited to the following:

Service Disruptions:

In some destinations, it is possible but unlikely that some services, for example, water, electricity, air-conditioning, security, sanitation, pools, restaurants and hot water might be suspended or interrupted during the traveller’s stay.

Construction:

To maintain the quality of services, hotel complexes must regularly undergo maintenance, improvement and renovation work. Whenever construction work is brought to the attention of AEBT or any tour operator, product or service providers represented by AEBT, every reasonable effort will be made to notify travellers as soon as possible. If appropriate every effort will be made to re-locate travellers to more suitable accommodation but this cannot be guaranteed.

Peak Travel Periods:

When travelling during holidays, school breaks, conventions and trade shows, travellers may be subject to certain inconveniences, which might include the cancellation or reduced availability accessibility of some services or attractions. Because these periods cannot always be predicted, AEBT or any tour operator, product or service providers represented by AEBT will not always be able to anticipate such periods. Whilst Ace will take all reasonable steps to minimise inconvenience, travellers must accept the possible consequences of travelling during these periods.

11. Room Allocation

Hoteliers are solely responsible for room allocation, in accordance with the category reserved by travellers. Should travellers choose to change their room category upon arrival at their destination (upon availability), they must make their own arrangements with the hotelier and accept responsibility for any charges incurred. Special requests concerning room amenities and location can be transmitted to the hotelier by AEBT. These requests cannot be guaranteed and do not constitute a contractual agreement between AEBT and the traveller.

12. Hotel Check-In and Check-Out Procedures

Travellers  recognise and accept that hoteliers, in accordance with international standards, request that occupants check in after 4 P.M. (16:00) on the day of arrival and check out by 11 A.M. (11:00) on the scheduled day of departure.

13. Photographs

Photographs appearing on AEBT’s Web site are for reference purposes only and shall not be construed as a binding part of this Contract. Travellers are advised to make their selection according to price, location and services offered. Hotel decor and furnishings may vary from room to room, in accordance with the individual location on the hotel premises.

14. Traveller Responsibility

14a.

Travellers are responsible for advising AEBT of their intentions, goals, motives, expectations and needs, as they relate to the proposed travel package, before completing their reservation. Travellers are responsible for ensuring that they are in adequate physical condition for travel, that they have a sufficient quantity of any required medication with them, and that they carry such medication in their hand baggage at all times. Prior to departure, travellers should consult a competent medical professional regarding possible preventative measures to be taken against ailments common to their travel destination.

14b.

AEBT or any tour operator, product or service providers represented by AEBT cannot be held responsible for the possible cancellation, operation or unforeseeable events that may occur during an excursion or optional tour purchased at the destination.

15. Force Majeure

AEBT or any tour operator, product or service providers represented by AEBT cannot be held liable for any delay, loss of personal belongings, injury, accident, mortality, damage, inconvenience, loss of enjoyment, upset, disappointment or frustration, either mental or physical, owing to a Force Majeure. That is to say, an unforeseeable event such as, but not limited to, the following:

16. Comments and Complaints

Travellers must notify AEBT of any problem immediately upon arrival at their destination in order to avoid delay in receiving assistance. In the event that a problem cannot be dealt with or resolved immediately, travellers are requested to forward the specifics of their complaint in writing to AEBT within ten (10) days. Failing which no action will be taken.

17. Laws

This agreement is governed by the laws of the State of Florida in the United States. Any legal action instituted against AEBT or any tour operator, product or service providers represented by AEBT must be heard before the courts of this state. For the purposes of any such proceedings, the parties hereby agree to elect domicile in the judicial district of Sarasota. The voiding of one or other of the clauses hereto shall neither annul nor invalidate this agreement, known as the “Terms and Conditions”.
